Cina Immigration Attorneys Oppose Hr 3808 –Scott Gardner Act Detaining Persons Who Look Like Illegal Aliens

Today the Subcommittee on Immigration Policy and Enforcement has hearings regarding the Scott Gardner Act, H.R. 3808.

This bill would force state or local law enforcement agencies to engage in immigration screening activities without federal reimbursement. This clearly constitutes an unfunded mandate and is therefore a violation of the 10th Amendment. As the now infamous Sheriff Joe Arpaio example makes clear, when states and localities engage in immigration enforcement what results is abuse and racial profiling by police officers. These abuses undermine the community trust in local law enforcement and degrade constitutional protection.

For this reason, CINA opposes H.R. 3808 because we believe it would compromise public safety rather than strengthen it.
